Stopping treatment of patients unable to express their validated will
The seat of the Constitutional Council on 18 March 2017
The Constitutional Council on Friday validated the provisions on the cessation of treatment by doctors of patients unable to express their wishes, provided that relatives can exercise a “effective” legal remedy against this medical decision.
In its decision, the Council provided guarantees to the relatives by stating that the decision to stop or limit maintenance salaries must be “notified to the persons from whom the doctor has inquired about the patient’s wishes in Conditions enabling them to exercise recourse in a timely manner “.
The Sages had been seized by the National Union of Families of Traumatized Cranial and Cerebro-Damaged Families (UNAFTC), deploring that the cessation of treatment of a patient incapable of expressing himself and which left no directive Is now the responsibility of doctors alone and believes that doubt about the patient’s wishes should benefit the “fundamental right to life”.
